Terms of service

These Terms & Conditions apply to your use of the Maxfli Australia website and to purchases made through our online store. By accessing or using this website, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use the website.

Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or restricted.

Website Use

You may use this website for lawful personal and commercial shopping purposes. You must not use the website in any way that could damage, disable or interfere with the operation or security of the website or interfere with another person's use of the website. We may update, change, suspend or withdraw any part of the website without notice where reasonably necessary.

Product Information

We make reasonable efforts to ensure product descriptions, specifications, images and other information displayed on our website are accurate. Colours and product appearance may vary slightly depending on your device, screen settings and photography. Product packaging, specifications or design may also change from time to time.

If a product you receive does not match its description or otherwise fails to meet a consumer guarantee under the Australian Consumer Law, your rights under the Australian Consumer Law apply.

Pricing

All prices displayed on the Maxfli Australia website are in Australian dollars (AUD) and include GST where applicable. Prices may change from time to time. The price applicable to your order is the price displayed when you place the order, subject to these Terms & Conditions.

If we discover an obvious pricing, product or website error after you place an order, we may contact you to explain the error and discuss the available options. Nothing in this section limits your rights under the Australian Consumer Law.

Orders

Placing an order through our website is an offer to purchase the products in your order. After placing your order, you will receive an order confirmation by email. This confirms that we have received your order. We may need to verify information relating to an order before it is processed.

We may decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • we are unable to process or verify payment;
  • we reasonably suspect fraudulent activity;
  • the quantity ordered suggests the products are being purchased for unauthorised resale; or
  • there has been an obvious website, product or pricing error.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled product or order to the original payment method.

Product Availability

Products are subject to availability. Occasionally, a product may become unavailable after an order has been placed. If we cannot supply a product you have ordered, we will contact you and provide an appropriate solution, which may include cancelling the affected product and issuing a refund.

Payments

Payment is required when you place your order. Available payment methods may include:

  • Visa
  • Mastercard
  • American Express
  • Google Pay
  • Shop Pay

Available payment options will be displayed at checkout. Payments are processed using secure third-party payment providers. Maxfli Australia does not directly store complete payment card details submitted through checkout. Your payment may be subject to additional terms and conditions imposed by your payment provider.

Shipping

Maxfli Australia currently delivers to addresses within Australia only. We do not currently offer international shipping. Available shipping methods, costs and estimated delivery timeframes will be displayed at checkout or on our Shipping page. Once your order has been dispatched, you will receive tracking information where tracking is available.

Delivery timeframes are estimates only and may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, peak trading periods and other disruptions. If we become aware of a significant delay affecting your order, we will make reasonable efforts to keep you informed. Nothing in this section limits any rights you may have under the Australian Consumer Law.

Delivery

You are responsible for providing a complete and accurate delivery address when placing your order. Where you provide an authority to leave or otherwise request that a carrier leave a parcel unattended, the carrier may leave the parcel in accordance with those instructions where it considers it safe to do so. Please check your delivery details carefully before submitting your order.

If an order is returned to us because the delivery details provided were incorrect or incomplete, we will contact you regarding redelivery or other available options.

Cancelling or Changing an Order

If you need to change or cancel an order, please contact us as soon as possible. We will try to accommodate your request, but orders that have already entered processing or been dispatched may not be able to be changed or cancelled. If your order has already been dispatched, you may be able to return eligible products under our Returns Policy.

30-Day Change-of-Mind Returns

We want you to be happy with your Maxfli purchase. In addition to your rights under the Australian Consumer Law, Maxfli Australia offers a 30-day change-of-mind return policy.

To qualify for a change-of-mind return:

  • you must request the return within 30 days of receiving your order;
  • the product must be unused and in its original condition;
  • the product must be returned with its original packaging where reasonably applicable; and
  • you must provide proof of purchase.

Unless otherwise agreed by Maxfli Australia, the cost of returning a product because you have changed your mind is your responsibility. Original delivery charges are generally not refundable for change-of-mind returns. Once we receive and inspect an eligible return, the refund will be processed to the original payment method.

This 30-day change-of-mind policy is separate from your rights under the Australian Consumer Law. The conditions and time limit above do not apply where a product fails to meet a consumer guarantee.

Faulty, Damaged or Incorrect Products

If your product is faulty, damaged, incorrect or does not meet a consumer guarantee under the Australian Consumer Law, please contact us.

We may ask you to provide photographs or other information to help us assess the issue. Depending on the circumstances, we may also need to inspect the product. Your rights and the remedy available will depend on the circumstances and the Australian Consumer Law. For example, where a product has a major problem, you may be entitled to choose a refund or replacement. Where a problem is minor, we may be entitled to provide an appropriate remedy, such as a repair, within a reasonable time.

Where you are entitled to a remedy under the Australian Consumer Law, Maxfli Australia will meet its obligations regarding reasonable return or transportation costs as required by law. Your rights under the Australian Consumer Law are not limited by our 30-day change-of-mind return period.

Refunds

Approved refunds will generally be made to the original payment method used for the purchase. The time taken for a refund to appear in your account may vary depending on your bank or payment provider. Any refund rights arising under the Australian Consumer Law will apply regardless of the provisions of our voluntary change-of-mind policy.

Promotions

From time to time, Maxfli Australia may run special offers, competitions or promotional activities. Where an offer has separate terms and conditions, those terms will apply to that offer in addition to these Terms & Conditions.

Reviews, Feedback and Submissions

If you submit a product review, feedback, comment or other content to us, you must ensure that the content is accurate and lawful and does not infringe the rights of another person. We may moderate or remove content where reasonably necessary, including content that is unlawful, misleading, offensive, fraudulent, defamatory, infringing or unrelated to the relevant product or service.

Privacy

We handle personal information in accordance with our Privacy Policy and applicable Australian privacy laws. Please refer to our Privacy Policy for information about how we collect, use, store and disclose personal information.

Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law. To the extent permitted by law, Maxfli Australia is not responsible for losses arising from circumstances outside our reasonable control or from use of the website in a manner contrary to these Terms & Conditions.

Changes to These Terms

We may update these Terms & Conditions from time to time. Any updated Terms & Conditions will be published on this website and will apply from the date they are published. Changes will not affect rights that have already accrued under applicable law.

Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. You and Maxfli Australia submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts. Nothing in this section limits any rights you may have under applicable Australian consumer protection laws.
